I just reviewed the New York Statutes ( BSC Article 3 Sections 304, 305 and 306) yesterday before drafting my post. You might want to take a look at them. I am not a New York attorney, and would certainly defer to a New York attorney's opinion. However, if I were to incorporate a company in New York...I would appoint a statutory agent as my preference in light of what I read.

I also reviewed the Secretary of State's web page for business incorporation. It would seem to indicate that a corporation must designate the Secretary of State as an agent to receive process as well as maintain a current address to which the Secretary of  State may mail said process. However, I would still defer to a New York attorney's opinion on the subject in the event that I may be misinterpreting something.
