Hi Robert, it seems that in my county 1 of every 100 companies carry e&o and it is accepted by majority of the agents that most examiners in our county dont have the e&o. I have yet to see anyone get sued in my county( since the clients have their own e&o policy).
I Know of the one examiner that got sued in PA That you had on your blog ( it looks like if he did not claim he had e&o he would have had less of a problem) , but do you know of many more actions against examiners.
Every once in a while we get someone that comes into our county thinking it is very easy ( it is for them since they don't run everything they should be running) , They solicit our clients with low prices and e&o coverage ( that's when we all start getting calls asking us if we have e&o) most of the agents are smart enough to stay with the seasoned examiner who has their reputation to uphold, where as some agents are swayed by the too good to be true offer, the only problem is these new examiners don't stay around long ( once the claims start coming into the agents ) ,so their e&o insurance ( if they really had it) does no good to that agent.
