I always cringe when I hear those ads.

As a title examiner, the county records would throw up a red flag immediately if the chain isn't in order.

You would have to have all parties but the actual, legal owner, in on the scam.

And, I'd like to know how the "service" can immedately spot and report any changes in a person's title.  They would have to be searching county records DAILY and probably several times a day!   

Technology is so much better these days, so most counties have real time recording, although there are some that lag several months behind.

And these scams seem to happen only with people who do not have existing mortgages.

I could see this being a problem 20+ years ago when county recording could be YEARS behind.  But I think that most counties are caught up to a reasonable date with at least a 6 month period.

One thing their ads aways say, the owner was vacated from their house - come on, that can take months - and wouldn't you IMMIDIATELY respond to a foreclosure or eviction notice and say What the Heck is this???

And, the bottom line is, that if the property was illegally stolen by a deed & mortgage scam, the courts would of course, overturn everything b/c you cannot convey title illegally.  And through the court system, the property would be returned "unharmed" to the original owner.
