Title Insurance is for the amount of the Purchase Price in the case of an Owner's Policy and the Loan Amount in the case of a Refinance. I am sure your disclaimer limits your liability by a whole heck of a lot more than the actual purchase price or loan amount. That really isn't even a fair comparison especially when you get to set your own limit at the cost of the search or whatever amount. It is peanuts compared to the potential loss we could take by relying on the fact that you did your job right.
When a claim gets made the person at fault should be the one to take care of it. If by some chance that fault falls to the examiner why should I have to pay for it. Because I issued a policy - based on your work that you claim to be proud of and thourough in but yet you still place a disclaimer on it.
Now, I know there are exceptions to the Policies like all insurance lines but those are extremely detailed and can be removed with the proper documentation etc.
And I know full well the problems with the indexes which is why I don't do my own internet searches. If we could rely on that we would have no need for contract examiners. then where would ya'll be? Seems to me a clear ducking of the responsibility of preforming your job to utmost because you can always fall back on the disclaimer.
