Unfortunately there is no accounting for the weight to be given to the evidence by the jury....always a crap shoot.

It is always interesting to watch the defendant's position shift and change as the trial date approaches. Very often the defendant will claim the matter for a jury trial simply because it will delay trial by a year or so. It is often an indication that he has no confidence in his case.  When he does that ...like a game of Texas Hold Em...it may be time to go "All In" if the other factors of the case warrant it.
