Subsurface rights, a very hot topic right now, are clearly a state-by-state issue. I recently read that in Texas, mineral rights do not even show in the land records and that it would be necessary to go to the original title to identify them, so that it is becoming standard procedure to show subsurface rights as an exclusion to coverage on title policies.
In other states, mineral rights are taxable interests that go tax forfeit to the state if unpaid and can be identified that way.
My suggestion would be to specifically state they are NOT being searched.
