I agree its an underwriters issue. However I also feel like the client (customer) relies on their "local title company" to offer them the best protection available. If the client does not know to ask for removal of the mechanics lien exception (why would he?) and then has a claim which ofcourse is not covered ( that arguably could have been if he had asked at closing....and ofcourse there would have been no additional premium charge for it - he just didn't ask !) you tend to feel a little insecure that you did not disclose this potentially "hot-button" issue up front and no coverage is now available for him since it is "excepted" in the fine print. This does not seem to help our industry that is accused of not paying enough claims already.
