Steve,

Unless people are buying the searches for entertainment purposes, I can't imagine how anyone, judges included, would buy a disclaimer like that.  Somebody is relying on the title search for some purpose.  It may get the E&O insurer off the hook, I don't know.   But I doubt it would be of much help to the abstractor.

Ideally, customers would buy title searches from competent abstractors, who can be insured with E&O coverage for the level of search they are performing.  And the compensation for the search would be in line with the liability incurred, as well as the labor expended.
