I have nothing against people from any country or any ethnicity. I understand companies off-shoring for cost benefits. Maybe they aren't associated with ESS but you can set up shop and incorporate anywhere you choose in the U.S. Some states offer benefits to incorporating in their state, such as strict privacy as to who owns the company and I'd say they'd be wise to investigate that further if they're trying to masquerade as a U.S. company but when the emails still generate from India and the person on the phone's English is "off" then what's the point?
And hey, you can privacy-up all you want but there's always Google.
