That's rather frightening when you think about it. The Framers never in a million years would have envisioned the rampant judicial tyranny which has been so pervasive to the federal bench. The idea that the Supreme Court has been imbued with an almost godlike status is anathema to the doctrine of separation of powers as set forth in the Constitution.
A few years back, there was an excellent book entitled "Men in Black: How the Supreme Court is Destroying America" written by Mark Levin, a Constitutional lawyer and President of the Landmark Legal Foundation (and in the interest of full disclosure for those who may not be aware, he's also one of those "right-wing talk show hosts" whom Mr. Franco so loves to hate). Levin's premise is that the courts (and the Supreme Court in particular) have done a yeoman's job of legislating from the bench. Not only does he explore this in great detail, he also outlines his views on how the damage could be undone. It's written in such a way that anyone can grasp its concepts (even us lowly non-lawyers who get our legal education from right-wing talk radio, lol). An interesting read overall.
