Apparently, Virginia has already sued the Federal Government over the new health care law.  Here's the AG's complaint. 

Virginia's right-wing AG, Ken Cuccinelli is a right wing firebrand.  He's a polarizing figure who will consistently be grandstanding on all the hot-button issues-- for instance, he recently caused quite a stir when he told Virginia's state universities to drop their anti-discrimination policies for sexual orientation.  He advised them that they had no authority to have such policies, since there was no such state law-- Washington Post
