Good luck on that one...the Commerce Clause is one of the most flexible areas of the constitution....it has been used to regulate everything from the mud flaps on trucks to civil rights legislation. Segregation of restaurants was deemed preempted by federal law because it placed too great a burden on interstate travel and commerce. It has been called a floating federal police power. Don't think Virginia's governor is going to have much luck with the argument
