It seems that the WV Bar has left the door open to the possibility of licensing abstractors.
Until there is mandatory licensing, education and training of real estate paralegals, non-lawyers hired or engaged in real estate practice by lawyers shall be bona fide employees of the lawyer, and not independent contractors.
Licensing would be in the best interest of independent title abstractors. The problem is that abstractors are apathetic to changing their lot in life. At present, NALTEA is the only association that has the potential to lobby for such changes, but abstractors are not joining in high enough numbers to give them the power to do it.
If I were in WV, I'd be rallying the troops and working on a concerted effort to get legislation in the works before it's too late.
