The WV bar association's draft UPL law (which Patricia Perry was kind enough to fax me) seems pretty clear on abstracts of title, even on your own property-- "Any title insurance commitment, binder, or policy shall not be issued unless it is based on a proper and dilligent examination conducted by, or caused to be conducted by, a licensed lawyer." There's no carveout for a person who does a title search on their own property, as far as title insurance.
There is a carveout for generating deeds on your own property-- "A non-lawyer may prepare a deed with respect to, or deed of trust secured by real estate owned by him".
It appears to be a very restrictive proposal. I hope to get up an article on it within the next day or two and Robert also has plans for a blog entry exploring the the proposal from a legal perspective.
