Patricia,
Here in Nebraska, the "unauthorized practice of law" rule is utilized and enforced. If you want to be an independant searcher, you are required to have an Abstracters License issued by the Nebraska Board of Examiners. In order to recieve the license, you have to send in an application with references, take and pass a very difficult TWO DAY EXAM, pay hefty fee's for both a Certificate of Authorization and Certificate of Registration, and attend a continuing Education Seminar every two years. It cost's quite a bit of money. But the "unauthorized practice of law" rule is not something that Attorney's here in Nebraska can utilize to "get Rid of Independant searchers." Unless the person is searching without the license...... then they can be prosecuted for the "unauthorized practice of law" rule.
