Here's what went on a recent title report of mine.
"Title is out of a foreclosure. Original mortgage was to MERS for Sherwood Mortgage Group Inc, dated & recorded 2003 at Book___, Page___. Order of Notice dated May 21, 2007 & recorded June 1, 2007 named The Bank of New York as successor etc as the mortgage holder at Book ____, Page____. Assignment from MERS to The Bank of New York is undated, but the notarization date is May 22, 2007 & was recorded February 8, 2008, Book____, Page____.
The foreclosure deed is signed under a power of attorney from The Bank of New York to Wilshire Credit Corporation dated & recorded February 8, 2008 Book_____, Page___. NOTE that by its terms the poa appears to have expired December 12, 2007.
Apparent scrivener's error on foreclosure affidavit- as follows: The undersigned, Joe Blow, holding the office or position as AVP of the Bank of New York Trust" etc is incorrect - he signs as an employee of Wilshire Credit Corporation as the attorney in fact for The Bank of New York.
The deed to the current owners is signed by an employee of Wilshire Credit Corporation under power of attorney from The Bank of New York. There are two handwritten notes on the document citing book & page references to both a vote & poa, but could not find either document on record at ROD."
