I am going to repeat myself - the rule of law applies to all individuals in this country -whether you, personally,  like it or not.

  Flouting or ignoring laws because they are inconvenient or time consuming results in even greater chaos. 

Your comments about poorly trained clerks & mountains of paperwork are specious arguments concerning the rule of law.  It takes what it takes to foreclose a mortgage in Massachusetts.  The only real reason that the system seems broken right now is due to the volume of foreclosures - not the procedures.  

To apply your argument to other areas consider this - why bother doing a fifty year title search on a purchase.  It can be quite time consuming; & can certainly generate a mountain of paperwork.  Why not just do a current owner - quick & easy - & let the chips fall where they may.  The title insurance companies can sort all the problems out later.  After all, it can take up to two months to close a loan on a purchase- longer if there's a title issue. 

What I believe you're arguing here is more about politics than the law which is not the same thing at all.
