Please read some of the blogs over on notary rotary before you recommend this.There are people over there waiting to be paid on this basis without even having to make that offer. They are complaining about not getting paid when the offer you propose was never part of the deal. Your proposal simply invite further abuse. It is a very simple matter for a title company to claim they had not been paid. Why invite further failure of payment for services rendered?
The problem with this is that your contract (verbal, written or implied in law or fact) is with the title company. In the case of refi's the borrower has the right to back out of the deal within three business days of the closing date without consequence (his right to rescind) he is not obligated to pay the abstractor.
