In Connecticut we file a suit under alternate theories of both contract breach and negligence to cover all the bases,  and we name both the corporation/LLC and the individual as defendants. The case law in Connecticut indicates that the contract can establish the duty owed for purposes of negligence .It is also an implied term of every contract that the work will be performed with reasonable care. Negligence has a shorter statute  of limitations than a contract claim.
