I basically take the same position as you.  It' not a RESPA violation.  My side question though is this, if another consumer goes to the same title agent and asks for the same discount, what would happen if that discount were denied?   I assume that the title agent could deny the request if the consumer were not part of the "class" to whom this discount is being offered. 

Any ideas on that?
