I still see it as fraud on the seller's part.  Again, I would think that if it went to court, it would go to the first one that signed as they should be the rightful owners regardless which one was filed.  I would like to see the seller sitting in jail for fraud. After all, he signed a contract and accepted the money from a second person knowing full well that he no longer owns the property.
