I have looked into a similar arrangement, by which a set referral fee would be charged for referring the order to the agent in the state where the property lies. I went as far as to read the terms and conditions on the website (I think it was run out of Michigan) and their disclaimer, and quickly decided to decline. Besides that, there seemed to be only a very few member agents at the time.
I'm no lawyer, but it seems to me that, by taking a referral fee and not performing any core title services, you might be running afoul of RESPA, Sec. 8(a)(b). I guess it depends on how your state, and the state where the transaction occurs, interpret the RESPA Sec. 8.
It seems pretty clearly a precarious arrangement to me, just based on what I've read over the years. If there is a convincing argument to the contrary, I'm interested to hear it.
