Good advice Alix, wish you would have posted this 6 months ago! Samantha, I received a notification from a vendor's insurance company that we had missed a mortgage on a property and that there was a pending claim against us, the abstractor... The mortgage that was taken out based on the search we did, was going into foreclosure and the claim was based on the fact that the mortgage we missed was superior. We missed the mortgage because it was a cross collaterized mortgage and only one of the legals was referenced in the index, the one not on our property. I spoke with my E & O carrier and they suggested that we take the inititiative and hire a lawyer to investigate. Our lawyer found that we were not at complete fault, but come to find out the mortgage was satisfied anyway. Now we are having to pay the $5000 deductible. We offered monthly payments since business is slow too, I'm sure yours will work with you if it comes down to it. We also, had a difficult time getting new policy when ours was up for renewal, the current policyholder wanted to charge us $8,000, for a policy that we had previously paid $2,500 for! So I shopped aroung and eventually had to go without a retroactive date and a lower insurance amount to get a policy for $3,000. In hind sight, it would have been better for us to take Alix's advice and just wait it out....
