I'm not an IP lawyer, but would imagine that the photographer owns the rights to his photos regardless of the subject matter. There is more to the photo than merely what the subject of it may be. There is also the artistic quality, e.g. how its framed, the lighting, exposure of the image, etc.
I would even argue that your example of using a photo of the courthouse would be protected by the photographer's rights. Surely, if you take the pitcure yourself, you could use it. However, if you are using someone else's photograph, you should probably get their permission.
There are several photos released with Associated Press articles, and many of them are of public figures or places. But, I would still be you that the AP has the copyrights to them.
