The illegality here could probably only be found in the notarization of the documents.  If the signer lied to the notary, by claiming to be that person, I think that would be criminal. If they didn't lie, the notary issued a knowingly false acknowledgment and that would be criminal.  But, its probably not fraud, which explains why no fraud charges have been filed.
