Yes, that is entirely possible.  Some of these suits would no doubt fail even if the court looked into the validity of the assignments.  But the point is, the court decisions that I am seeing do not even touch whether the assignments are valid or not, so even if it were the case that the borrower was correct that the assignment was flawed, they'd still lose.
