The note and the mortgage provide for different remedies. When a foreclosure is initiated the Plaintiff's attorney drafts several different counts in the complaint. The note gives rise to a legal remedy for the cash value of the note. The mortgage gives rise to an equitable remedy by which the mortgage holder takes title to the property.
