In the cases I have researched so far the problem seems to arise where one spouse is 62 and qualifies, and the younger spouse is not 62. In cases in which the younger spouse quit claims his/her interest to the older spouse she no longer holds a title interest. Therefore there is no obstacle to foreclosing the deceased spouse's 100% title interest.
