Source of Title Forums: Re: Abstractor Missing Mortgage

When you enter into a contract the parties agree to a term implied at law that each will exercise reasonable care in performance of their respective duties. When one party fails to exercise reasonable care it exposes them to a claim for contract breach. It is the contract law alternative to a suit for negligence.
