I had a recording counter clerk reject a deed given from a corporation to an individual (the President of the corporation) for nominal consideration because it was clear to him that my client was trying to defraud the Commonwealth of Massachusetts, by understating the value of the property & so evading the requirement to pay transfer tax fees.
It took literally hours to get that deed recorded. There is no statutory requirement other than ensuring that the deed is drawn correctly (grantor, grantee, date, acknowledgement, consideration, legal description) for it to be recorded. Inventing a back story in order to keep me from getting on record was astonishing & annoying. After arguing with both this man & his supervisor I had to wait until they both went to lunch & recorded with someone else.
