Has anyone else run into "new requirements" that are rather ridiculous for 1 owner searches? I have two clients who are going by some 1st American guidelines that say we have to go back 30 years for easements restrictions FOR A 1 OWNER SEARCH. And look for access easements. Oh, and let's not forget MINERAL searches.
This last requirement is going to get someone in really big trouble. Just because you go back 30 years doesn't mean you know who owns the minerals/oil/gas -- not if the rights were severed decades prior. It would then be a completely separate chain of title.
We're supposed to do a full search for a 1 owner fee all of a sudden??
