Probably not because they did provide the search to the consumer ultimately. RESPA is designed to protect consumers, not abstractors,  I think you are going to have to use the regular civil remedies to get paid.  And you do deserve to get paid.  We pay our abstractors, even if the deal does not close.  Its a cost of doing business.

AND besides, RESPA is going to be gone next summer anyway.  It's getting rolled into TIL.
