I would think that if your state is one that now recognizes same-sex marriage it would be treated the same as a traditional married couple, legally speaking. In Ohio, that would mean each would have a dower interest, for example.
As for what to call it, I would use the same language I find in the document - it is not really our job to interpret, only to report. I would imagine, it would be "married to each other" or "husband and husband," or "wife and wife." You will have to let us know what language you see when they start to file more documents as married same-sex couples.
