I have had to do it.. with great success.. Hire an attorney if you are incorporated and file in Court.. just like any other civil hearing, for any other debt owed. 

if what is owed is under your states amount in conciliation, go that route.. Mine was over, got to the courthouse steps the day of the hearing and received a check in full before the hearing...settled.  I called the bluff.. but I also did it right away.. I didn't wait for the line to show up, Like EMPLOYEES, who get paid first in all situations..
