I'm anticipating a greater focus on MERS-related assignment chains, especially in PA and other "title theory" states, after the dust settles from the big loss in Montgomery County, PA v. MERS.
I expect to see banks scrambling to establish ownership of notes in new and creative ways, and attempting to cure a lot of defects that arose from the tax-evading MERS scheme that may soon be challenged in every state where a transfer of a note explicitly must be recorded.
Should be interesting to see how that one pans out.
