For our Title Ops division, we let all of our clients know that our focus is residential real estate. However, we also let them know that we accept commercial work on a limited basis. If a client assigns a file that is commercial property, we will do some initial research and do one of the following:
1) Complete the search
2) Let the client know if it would require additional billing, indemnity letters, etc.
3) If the file is very extensive, let the client know if we cannot complete it in a timely manner and suggest that they reassign (this option is rare).
While we do not cover every county nationwide, we do cover every county in WV. WV is an attorney state and title searches are the practice of law, therefore must be completed by an attorney or a bona fide full time employee of an attorney. Our services are always completed in full compliance of WV law and never farmed out to an independent contractor/abstractor. Our clients know that they are receiving a quality product with a reasonable fee, not soliciting an independent in the unauthorized practice of law.
