Makes me wonder if this goes on a lot more than we know and maybe we shouldn't be doing "just one owner searches" at all!

A current owner search involves a conscious risk decision, and actually I think your example might really demonstrate why a lot of companies choose to do it--so you've disclosed this defect, but what exactly is the risk that's attendant to it?  Who has a claim and against whom, and how likely are they to make it?
