The responsibility for the Lender's CD lies with the Creditor (lender). In my local area, it is normally produced by the lender. As Victoria's response shows, in some areas the lender has the closing agent produce it. In either case, it is collaborative between the two sides, with ultimate responsibility for accuracy and delivery resting with the lender. Many lenders use a program that interfaces with title/escrow production software.

The responsibility for a Seller's CD lies with the closing agent. The Creditor receives a copy of the Seller's CD, but the responsibility lies with the closing/escrow agent for the accuracy and delivery.
