Robert, uniformity of a title report is something that can easily accomplished if we estalish the LLC. It is only a matter of coming up with a form to be used by all of the searchers. The issue of thin title plants could be used as a great marketing tool, if we can generate objective evidence to show potential clients. It greatly enhances the role of the abstractor as opposed to that of an employee merely transferring questionable data from a computer monitor to a piece of paper.
Right now I am leaning toward the structure of the LLC you outlined above. Marketing could be done either in house or through an outside firm. If Naltea wanted to play a role in the marketing, that is fine. I do think though that the ownership of the separate LLC should remain with the investors (participating abstractors). I also think that work assignment should come through the LLC rather than left to the discretion of a client. Otherwise we are no better off than we are now, and the participating searchers are at each others throats for work. If we decide to seek subcontracting of title work from the title companies,, and market it on a cost savings basis, this is the service for which we are to be paid. It does not seem to make sense to throw it back on the title company
