Here in Florida a right-of-way is generally understood to mean a road way, and generally public. The State or County purchases land for road rights-of way. Developers must provide r/w in their subdivisions which are dedicated to the public, and maintained by the county.
With easements - it is understood that the user does not have title to the land, only the right to use it for whatever purpose.
