I don't know about indicting but there has been talk of class action suits against the clerks as well as the attorney general. There are already class action suits in Alaska, Ohio, and New Jersey. One recent case in Florida the 11th Circuit Court of Appeals ruled that individuals can qualify to receive monenary damages even if they did not suffer financial harm.
This would include every taxpayer who finds his name, address, social security number, driver's license number, signature or mother's maiden name published over the Internet by their public officials.
Here is part of the ruling,
"Damages for a violation of an individual's privacy are a quintessential example of damages that are uncertain and possibly unmeasurable. Since liquidated damages are an appropriate substitute for the potentially uncertain and unmeasurable actual damages of a privacy violation, it follows that proof of actual damages is not necessary for an award of liquidated damages."
