Maybe we are not interpreting the facts the same way. As I understand it, Joe Blow was the successful bidder at the sheriff's sale. Before the sale was confirmed, he assigned his bid to the LLC. I assume, then, that the sale was confirmed and a sheriff's deed was recorded conveying the property to the LLC.
In Ohio (not sure about New York) a successful bidder at a sheriff's sale does not have a vested interest in the property prior to confirmation. It is the confirmation of sale that transfers title. Thus, the way I read the facts Joe Blow never had an interest in the property.
