Robosigning, Document Forgery, Foreclosure Fraud... Problem Solved!
by Slade Smith | 2011/03/03 |

Sometimes, I get frustrated that the government never seems to be able to fix anything in this country.

For instance, we can't seem to effectively stop mortgage banks and their foreclosure mills from introducing forged and fraudulent evidence of land titles into the public records. Sketchy docs are filed in courthouses and used in courtrooms every single day.

Good news, though-- I have the perfect solution!

What we need is for someone to take charge of the situation and not only stop the fraud, but to get rid of all the forged and fraudulent documents that already exist, right?

Well, I've got an idea for the perfect man for the job-- perhaps the only man in the world who has single-handedly cleaned up all the forged land title documents in an entire country-- Libyan military strongman Colonel Mu'ammar Gadhafi!

In 1992, Reuters News Service reported that Libyan leader Mu'ammar Gadhafi had incinerated Libya's land titles. "All records and documents in the old land register, which showed that a land belonged to this or that tribe, have been burned," Colonel Gadhafi reportedly informed a meeting of his justice ministry. "They were burned because they were based on exploitation, forgery, and looting."

That's the kind of thinking outside the box that we need to bring integrity back to our land records.  And, from what I hear, he's going to be looking for work soon!  Can you say "Foreclosure Fraud Czar?"

(I wonder if those Libyan tribes were using robosigners?)

That is certainly one way to do it...

A democracy may be an inefficient form of government, as you say "we can't seem to effectively stop mortgage banks and their foreclosure mills from introducing forged and fraudulent evidence of land titles into the public records," but things could be worse!

That was back in 1992... I wonder what ever became of it?

Great Idea

Now why didn't we all think of this earlier!!

I tried to find out more about it...

... but came up empty.  The original Reuters item was not available in Google's news archive, and I found no other articles from around that time that mentioned it or provided any background.  As usual, I can never find the info I really would like to have on the internet :-(

Online public records

More open governance with more things transparent and online could bear with it a mixture of good and bad opportunities.

Some States like Nevada and Arizona already have indices AND the Official Records online for anyone to view.  This, on it's surface, does not appear to have created any new and spectacular claims of fraud, and may be contributing to records integrity by exposing title records to a bigger audience.

While the Fed is contemplating a Torrens-like national land system, and I've said we should privatize the whole dang mess, perhaps a third avenue is available for exploration:  lets' build for the future and create an intergalactic recording service.

The Scientologists can record Zenu's volcano properties, the Area 51 groups can stake claims for landing sites to be probed at, the Ralean's will have a spot for the next comet ride, and the rest of the loonies can scout prospective Lunar lands.

This will save us a LOT of research work, if we do it now!
